Welcome to PublicSchools.us. By accessing our website, purchasing a subscription, or using our School Data & Intelligence API (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

1. License and Permitted Use

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the API data solely for integration into your applications, websites, or internal business operations.

No Reselling: You may not resell, sub-license, rent, lease, or redistribute the raw API data or provide direct access to the API to any third party.
No Database Scraping: You are strictly prohibited from using mass-scraping, crawling, or systematic extraction techniques to build a standalone, competing database or clone of our data infrastructure.
Caching Policy: To optimize your application's performance, you are permitted to cache API responses locally for up to 30 days. Permanent storage or archival of the historical raw data is not allowed.

2. API Usage, Limits, and Overages

Account Security: You are entirely responsible for maintaining the confidentiality of your API keys. Any activity originating from your API keys will be treated as your activity.
Rate Limits: We implement technical rate limits (requests per second/minute) and monthly volume caps based on your chosen tier.
Abuse: If your application exceeds these limits or causes degradation to our infrastructure, we reserve the right to temporarily throttle or suspend your API access to maintain service stability for all users.

3. Subscriptions, Billing, and Refund Policy

Billing: All paid plans are billed on a recurring subscription basis (monthly or annually). You agree to provide valid billing information and authorize us to charge the payment method on file.
No Refunds: Due to the digital nature of API data delivery and the fact that resources are provisioned immediately upon purchase, all fees are non-refundable. You can cancel your subscription at any time to prevent future automated renewals.

4. Data Accuracy Disclaimer ("As Is")

School attendance zones, district boundaries, and ratings are administrative datasets that change frequently at the local, county, and state levels.

While we strive to maintain the highest standard of data intelligence, all data is provided on an "AS IS" and "AS AVAILABLE" basis.
We do not guarantee 100% accuracy, completeness, or timeliness of the school boundaries or ratings. The data is intended for informational and analytical purposes only and should not be used as the sole basis for binding legal or financial decisions (such as home purchases).

5. Service Availability and Limitation of Liability

Uptime: We use high-performance cloud infrastructure to maximize API availability. However, we do not guarantee uninterrupted or error-free uptime. Scheduled maintenance, network anomalies, or upstream provider outages may occur.
Limitation of Liability: To the maximum extent permitted by law, PublicSchools.us, its founders, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, revenue, or data, arising out of your use or inability to use the Service, even if advised of the possibility of such damages. In no event shall our total liability exceed the total amount paid by you to us in the 3 months preceding the claim.

6. Termination

We reserve the right to suspend or terminate your account and API keys immediately, without prior notice or liability, if you violate these Terms of Service, engage in fraudulent activities, or fail to pay subscription fees.

7. Governing Law

These Terms of Service and any disputes arising from them shall be governed by and construed in accordance with the laws applicable to the operational jurisdiction of PublicSchools.us, without regard to conflict of law principles.
